January 14, 2019 Katie MacFarland National Institute of Standards and Technology 100 Bureau Drive, Stop 2000 Gaithersburg, MD 20899 Via Electronic Mail Re: Developing a Privacy Framework, Docket Number: 181101997–8999–02 Dear Ms. MacFarland: New America’s Open Technology Institute submits the following two previously-filed comments in NIST’s Developing a Privacy Framework proceeding. The first comment focuses on substantive privacy protections, and was originally filed in the consumer privacy docket at the National Telecommunications and Information Administration. That proceeding asked similar questions as this proceeding. The second comment focuses on data portability and platform interoperability, two issues relevant to NIST given their technical nature, and was originally filed in the Federal Trade Commission’s docket seeking broad input on the FTC’s authority. OTI submits these two sets of comments for the NIST privacy docket. Thank you. Respectfully submitted, /s/ Eric Null Eric Null New America’s Open Technology Institute 740 15th St NW, Suite 900 Washington, DC 20005 Before the National Telecommunica...
