5.05.07 Duty Station and Per Diem
5.05.01
PURPOSE
This subchapter states the policies and procedures to be followed in
the NIST Industry Fellows Program. Under this Program, NIST staff may be
assigned to work at U.S. industrial locations as NIST Industry Fellows.
The purpose of this Program is to provide selected NIST staff with first-hand
experience in an industrial R&D setting, thereby enhancing staff development
and staff appreciation of industrial R&D, manufacturing of other industrial
operations (including marketing), issues, and trends.

SCOPE
This subchapter applies to all NIST employees.
5.05.03
POLICY
NIST encourages its staff to work collaboratively with U.S. industry
via several mechanisms, such as Cooperative Research and Development Agreements
(CRADAs), Guest Researcher Agreements, cost sharing agreements, or cost
reimbursable agreements.
The NIST Industry Fellows Program is used for those situations when
NIST may better achieve an understanding of industrial R&D, manufacturing,
or other industrial issues by experiencing the ongoing activities of a
host company at the company's location.

5.05.05
CONDITIONS FOR USE
a. The assignment identifies technical trends and opportunities, and
fosters the deployment and use of advanced technology.
b. The researcher will gain industrial R&D perspectives best through direct contact with a host company's industrial research, development, and operations environment.
c. The NIST Industry Fellow plans to be at the company's site for at least three months but less than eighteen months.
d. The parties agree that the NIST Industry Fellow is expected to return
to NIST for at least one year as a NIST employee following the end of the
fellowship.

ELIGIBILITY
All NIST employees (full-time permanent, part-time permanent, full-time
temporary, and part-time temporary employees) are eligible to participate
as NIST Industry Fellows.
5.05.07
DUTY STATION AND PER DIEM
a. The NIST Industry Fellow works at the company's site; however, there
is no change in permanent duty station for the Industry Fellow. NIST supports
the travel and per diem expenses of the Industry Fellow through a long-term
travel order in accordance with the GSA Federal Travel Regulations. The
NIST Industry Fellow receives no compensation of any kind from the company.

APPROVAL AUTHORITY
The OU Director and division chief, through the approval memorandum,
approve the proposed NIST Industry Fellows Agreement. The OU Director,
Deputy Chief Counsel, and Chief of the Industrial Partnerships Program
sign the Agreement.
5.05.09
RESPONSIBILITIES
a. The NIST Industry Fellow/Division - The prospective NIST
Industry Fellow submits an approval memorandum with an attached statement
of work, statement of purpose, and intended duration through the OU management
chain to the Industrial Partnerships Program. After approval, the NIST
Industry Fellow's division works with the Office of the Comptroller to
develop the long-term travel order. The division must attach the approval
memorandum to the long-term travel order. The NIST Industry Fellow makes
necessary personal arrangements for the assignment, e.g., ensuring health
coverage at the new location.
b. The OU Director/Division Chief - OU management reviews the proposed activity and, if approved, forwards the approval memorandum to the Chief of the Industrial Partnerships Program for implementation.
c. The Industrial Partnerships Program - The Industrial Partnerships Program prepares and transmits execution copies of the standard NIST Industry Fellows Agreement to the company, negotiates modifications, signs agreements, maintains permanent records of agreements, maintains the database, and sensitizes Fellows to intellectual property concerns.
d. NIST Deputy Chief Counsel - The NIST Deputy Chief Counsel provides legal review of NIST Industry Fellows Agreement.
