10.16.01
PURPOSE
This subchapter establishes NIST policy for administering the employment of NIST members of the Senior Executive Service (SES) and specially qualified scientific and professional personnel covered under 5 U.S.C.3104 (ST-3104).
 

10.16.02
SCOPE
 This subchapter includes all SES and ST-3104 employees of NIST.
 

10.16.03
AUTHORITY
The SES was established under Title IV of the Civil Service Reform Act of 1978, PL 95-454. Most SES operational activities are assigned by law to federal agencies.

5 U.S.C. 3104 authorizes the establishment outside of the General Schedule of scientific and professional positions carrying out research and development functions which require the services of specially qualified personnel.

The Department of Commerce Executive Personnel and Policy Manual provides the authoritative reference for DoC's policies and procedures relating to its executive resources. The Manual is available from the SES Coordinator in the NIST Office of Human Resources Management (OHRM).
 

10.16.04
POLICY DEVELOPMENT AND ADMINISTRATION
 The Technology Administration Operating Executive Resources Board (TA OERB) is responsible for developing policy, overseeing, coordinating, and, where appropriate, conducting functions consistent with carrying out the policy decisions of the DoC ERB (Executive Resources Board).

The TA OERB is divided into a General Board, located within the Office of the Under Secretary for Technology Administration, and a Limited Board, located at NIST and chaired by the NIST Deputy Director. The NIST Limited OERB oversees the management of executive resources at NIST.
