5 U.S.C. 3104 authorizes the establishment outside of the General Schedule of scientific and professional positions carrying out research and development functions which require the services of specially qualified personnel.
The Department of Commerce Executive Personnel and Policy Manual provides
the authoritative reference for DoC's policies and procedures relating
to its executive resources. The Manual is available from the SES Coordinator
in the NIST Office of Human Resources Management (OHRM).

POLICY DEVELOPMENT AND ADMINISTRATION
The Technology Administration Operating Executive Resources Board
(TA OERB) is responsible for developing policy, overseeing, coordinating,
and, where appropriate, conducting functions consistent with carrying out
the policy decisions of the DoC ERB (Executive Resources Board).
The TA OERB is divided into a General Board, located within the Office of the Under Secretary for Technology Administration, and a Limited Board, located at NIST and chaired by the NIST Deputy Director. The NIST Limited OERB oversees the management of executive resources at NIST.
